1. Who we are
thedigitalnomad.io is operated by Digital Nomad Media LLC ("Digital Nomad", "we", "us"), which provides development, configuration and digital asset services for video game servers and communities. Contact: admin@thedigitalnomad.io.
2. What this site is
This site is a catalog and an enquiry channel. Listings describe services and indicative pricing; they are not offers capable of acceptance. No contract exists between us until we have agreed a written scope and price for your specific project and you have accepted it.
3. Quotes and scope
- Prices shown on listings are indicative starting points, in US dollars, excluding any applicable taxes.
- Every project is confirmed by a written scope stating what will be delivered and what is excluded.
- Work outside an agreed scope is quoted separately and only proceeds with your approval.
- Quotes are valid for 30 days unless stated otherwise.
4. Payment
- Fixed-price work: 50% on acceptance of scope, 50% on handover, unless agreed otherwise.
- Hourly work: invoiced weekly in arrears.
- Retainers: invoiced monthly in advance, cancellable with 14 days' notice before the next cycle.
- Invoices are due within 14 days. Work may pause on overdue accounts.
5. Delivery and acceptance
Timelines given are estimates made in good faith and depend on you providing access, assets and feedback in reasonable time. You have 14 days from handover to raise issues against the agreed scope. After that, further changes are treated as new work.
6. Intellectual property
- On full payment, you receive ownership of the bespoke work produced for you, delivered as unobfuscated source.
- We retain ownership of our pre-existing libraries, tools and general know-how, and grant you a perpetual, non-exclusive licence to use any of it embedded in your deliverable.
- Catalogue resources sold as products are licensed for use on servers you operate, not for resale or redistribution.
- You keep ownership of anything you supply to us.
7. Support and warranty
Bespoke commissions include 90 days of bug fixes from handover. Catalogue resources include 12 months of updates. A "bug" is a deviation from the agreed scope. Changes caused by game, framework or third-party updates after handover are new work, quoted separately.
8. Your responsibilities
- You are responsible for your server, your hosting, your players and your community.
- You must hold the rights or permissions needed for any assets, code or content you supply to us.
- You must comply with the terms of the platforms you operate on, including those of the relevant game publishers.
9. Limitation of liability
Nothing in these terms limits liability for death, personal injury, fraud, or anything else that cannot lawfully be limited. Subject to that, our total liability arising from a project is limited to the fees you paid us for that project, and we are not liable for lost profit, lost data, lost players or other indirect losses.
10. Refunds and cancellation
You may cancel a project at any time. You remain liable for work completed up to the point of cancellation, and we will hand over what exists. Deposits covering work already performed are non-refundable. If we cancel, we refund anything paid for work not yet performed.
11. Third-party trademarks
Digital Nomad is not affiliated with, endorsed by or sponsored by Rockstar Games, Take-Two Interactive, Cfx.re, The Indie Stone, Mojang, Microsoft, Facepunch Studios or Studio Wildcard. All trademarks are the property of their respective owners and are used only to describe compatibility.
12. Changes to these terms
We may update these terms. The version in force for your project is the one published when your scope was agreed.
13. Governing law
These terms are governed by the laws of the jurisdiction in which Digital Nomad is established, and disputes are subject to the exclusive jurisdiction of its courts.
